Judge denies Change of Plea agreement in Homicide case

During the Change of Plea hearing on Feb. 27, the presiding Northwest Judicial District judge, denied the Plea agreement between the State of North Dakota and defendant Hugo Hernandez Jr., in regard to the 2023 shooting death of Brianne Anderson.
After listening to arguments from both Attorney Madden for the State, and Attorney Chapman, representing Hernandez, the presiding judge stated in part “...I am not able to make any changes to this agreement, but frankly...I am not satisfied with the agreement at this time and I am not accepting the agreement and the matter will be placed back on the trial calendar.”
According to the order filed on Feb. 28, both parties have to file an estimate of when this case will be ready for trial by March 14, 2025.
