Supreme Court Justices visit Alexander Public School

“Visitation is presumed to be in the child’s best interest because it’s not just the privilege of the parent, but a right of the child,” stated Attorney Jacob Marburger to a panel of four justices from the North Dakota Supreme Court.
Last week at Alexander Public School, you may have felt a sense of tension if you were one of the many who got to sit in on a child custody case being tried by two attorneys in front of four justices from the North Dakota Supreme Court.
“I thought it was interesting how the attorneys determined (the tone of) the court room, not the Supreme  Court justices,” said Windy Jacobson, Alexander Public School senior.
As each of the attorneys were presenting their side to a case of a divorced couple who couldn’t come to an agreement on visitation time and parenting schedules, students would soon learn that an argument often has many layers.
“A restriction of visitation must be based on a preponderance of the evidence and it must be accompanied by a detailed demonstration of physical or emotional harm likely to result from visitation(s),” stated Marburger.
